CANBE HOSPITALITY (“CANBE”) – TERMS AND CONDITIONS

1. IMPORTANT
1.1 Please read these terms and conditions carefully.
1.2 All bookings made via Participating Websites or with CANBE directly are made subject to these terms and conditions and the person making the booking will be deemed to have accepted these Terms and Conditions on behalf of all persons who will be staying at the Participating Property under the booking once any payment is made in relation to the booking.
1.3 Bookings may also be governed by and subject to additional terms and conditions which are applied by individual Participating Properties. These terms and conditions may relate to items such as payments, deposits and cancellations and you should confirm the exact conditions directly with the Participating Property before booking.
1.4 If there is any inconsistency between the Participating Property terms and conditions and these Terms and Conditions, the latter will prevail.
1.5 Some Terms and Conditions vary according to the property type or according to booking type (for example Peak Time Bookings). You should ensure that you read the Terms and Conditions carefully to ensure you are aware of the Terms and Conditions which apply to your particular booking.
1.6 If any part of your booking falls on a date which is classified as a Peak Time Booking date then your entire booking will be deemed a Peak Time Booking and any terms or conditions which apply to Peak Time Bookings will apply to your entire booking.
1.7 Any prices, fees, deposit amounts or charges which are specified or referred to in these terms and conditions are in euro.
2. Definitions
2.1 In these Terms and Conditions:
2.1.1 “CANBE” means CANBE Limited and its associated trading names including but not limited to Canbe Hospitality, ‘Canbe – Broc House’, ‘Canbe – Garden Lane’, ‘Canbe – Five Lamps’, ‘Canbe – Pearse Street’, Rosie O’Grady’s, and The Maltings Guesthouse.
2.1.2 “Participating Properties” means any property associated with CANBE (each a “Participating Property”), including but not limited to:
(a) ‘Canbe – Broc House’, 53 Nutley Lane, Donnybrook, Dublin 4 (Holiday Suites);
(b) ‘Canbe – Five Lamps’, 5-6 North Strand Road, Dublin 1 (Holiday Suites);
(c) ‘Canbe – Pearse Street’, 130 Pearse Street, Dublin 2 (Holiday Suites);
(d) ‘Canbe – Garden Lane’, Garden Lane, Christchurch, Dublin 8 (Holiday Hostel);
(e) The Maltings, Castle Street, Birr, Co. Offaly (Bed & Breakfast).
2.1.3 “Monthly Booking” means a booking at any Participating Property for a minimum period of 30 consecutive nights.
2.1.4 “Participating Website” means www.canbe.ie, www.booking.com, www.airbnb.com, www.expedia.com,www.hotels.com,www.hostelworld.com,www.themaltingsbirr.com, www.tripadvisor.com and any website owned by CANBE or pertaining to a Participating Property.
2.1.5 “Peak Time Booking” means a booking at any Participating Property which is advertised as a Peak Time Booking (which means at a rate higher than the Standard Rate) or which you have been notified by CANBE is a Peak Time Booking or which is listed on a Participating Website as a Peak Time Booking.
2.1.6 “Pre-Paid Booking” means a booking at any Participating Property at a rate which is lower than the Standard Rate and is conditional upon the full amount being pre-paid at the time of booking.
2.1.7 “Standard Booking” means a booking at any Participating Property other than a Peak Time Booking, a Monthly Booking or a Pre-Paid Booking.
2.1.8 “You” and “Your” mean the person who is making the booking.
3. Photographic Identification
3.1 When you check-in you may be asked to provide photographic identification.
3.2 If you are unable to provide such identification your booking may be cancelled and you may be liable to pay CANBE an amount equal to the full booking amount plus any other costs incurred by CANBE in connection with the booking. Accordingly, any pre-payment you have made in relation to the booking will be forfeited to CANBE under this term.
4. How To Book / Quotes and Reservations
4.1 Bookings can be made online via any of the Participating Websites or with CANBE directly by calling 01 2196539 (from Ireland) or +353 1 2196539 (from overseas).
4.2 Bookings are subject to the availability and applicable pricing of the relevant Participating Property at the time of the booking and some conditions and/or exclusions may apply, including but not limited to minimum and maximum stay requirements.
4.3 Any quote given is an estimate only of price and the price will only be confirmed once a payment is made on the booking and you receive written advice from CANBE that the payment has been received and the booking has been confirmed.
4.4 Any confirmed price is subject to change if:
4.4.1 a payment which is due on a booking is not received by CANBE by the date the payment is due;
4.4.2 there is a change in or imposition of a government charge, tax or levy which entitles or necessitates CANBE changing the price of your booking; or
4.4.3 any details relating to your booking are amended, for example your dates of stay, your room type or the number of persons staying under your booking, in which case clause 9 will apply.
4.5 If the price of a booking is changed under clause 4.4 you may pay the new price for your booking or cancel your booking and receive a full refund less any cancellation fees applicable.
5. Payment
5.1 Payments may be made by Visa, Mastercard, American Express, Visa Debit, cash (euro only), personal or bank cheques/drafts or electronic transfer (allow 7 days transaction time).
5.2 A 2.5% surcharge will apply to American Express transactions.
5.3 CANBE accepts no responsibility for monies paid by you to a travel agency or Participating Website until cleared funds are received in the bank account of CANBE.
6. Deposit and Final Payment
6.1 All Bookings require a valid credit card which is pre-authorised at the point of booking.
6.2 Reservations booked on a pre-paid, non-refundable rate require that 100% of charge is payable at booking stage where credit card details are provided. The total charge of the booking may be charged any time after booking.
6.3 If any deposit or final payment is not received by the due date, CANBE reserves the right to cancel the booking and any monies paid by you in relation to your booking will forfeited to CANBE.
6.4 Once final payment of your booking has been made confirmation of that payment and your booking will be sent to you via email or post to the email or postal address you provided at the time you made the booking.
7. Rates and Charges
7.1 The currency applicable to any quoted rates will be specified with the quoted rate.
7.2 All quoted rates are subject to change at any time until full payment is received.
7.3 Quoted rates are inclusive of all compulsory government or regulatory charges and taxes (for example VAT) where applicable.
7.4 Quoted rates do not include transport to or from the Participating Property or items of a personal nature including but not limited to laundry, telephone, taxis, room service, meals or transfers, airport taxes, unless otherwise indicated.
7.5 Some rates which are quoted are valid only for a minimum number of nights (e.g. Monthly Bookings) and if the number of nights included in your booking changes the rate may also change.
7.6 Monthly Bookings (where available) are quoted based on minimum stay of 30 nights. If the reservation exceeds 30 nights, the monthly rate will not be divided to produce a nightly rate. Any excess nights will be charged at the current Standard Booking rate.
7.7 Pre-Paid Bookings are conditional upon full payment of the total booking price at the time of booking. Pre-Paid Bookings are strictly non-refundable.

8. Refunds
8.1 Where a booking is cancelled, CANBE will refund any monies paid by you subject to the application of any cancellation fees under Clause 10.
9. Amendments
9.1 All amendments are subject to the availability and applicable pricing of the relevant Participating Property at the time the amendment is requested.
9.2 Amendments may be requested in the following manner:
9.2.1 More than 7 days prior to your scheduled check-in time: via a Participating Website or by calling +353 1 2196539.
9.2.2 Within 7 days of your scheduled check-in time: by calling +353 1 2196539.
9.3 The following charges will apply to amendments requested and approved:
9.3.1 More than 7 days prior to your scheduled check-in time: no amendment fee will apply.
9.3.2 Within 7 days of your scheduled check-in time: a €50.00 amendment fee may apply at the discretion of CANBE management.
9.4 If the rate which applies to an amended booking is greater than the rate which applied to the original booking, you must pay the difference along with any amendment fee in full at the time the amendment is approved.
10. Cancellation
10.1 If a booking is cancelled any non-refundable deposit or payment which you have paid will not be refunded and additional cancellation charges may apply under this clause 10.
10.2 For Standard Bookings, if you cancel your booking the following charges will apply in relation to each booking:
10.2.1 More than 7 days prior to your scheduled check-in time: no cancellation fee will apply.
10.2.2 Within 7 days of your scheduled check-in time: a 100% cancellation fee will apply.
10.3 For Peak Time Bookings, if you cancel your booking the following charges will apply in relation to each booking:
10.3.1 More than 7 days prior to your scheduled check-in time: no cancellation fee will apply.
10.3.2 Within 7 days of your scheduled check-in time: a 100% cancellation fee will apply
10.4 For Pre-Paid Bookings, the total charge for the reservation may be charged any time after booking:
10.4.1 If cancelled, modified or in case of no-show, the total price of the reservation will be charged.
10.5 For Monthly Bookings: if you cancel your booking the following charges will apply in relation to each booking:
10.5.1 More than 7 days prior to your scheduled check-in time: no cancellation fee will apply.
10.5.2 Within 7 days of your scheduled check-in time: a 100% cancellation fee will apply
10.6 Any cancellation fees payable by you will be deducted from any monies paid by you to CANBE and if insufficient funds are available, CANBE may charge the credit card details you provided at the time of making your booking.
10.7 Where applicable the balance of any monies paid by you after any applicable cancellation fee has been deducted will be refunded by CANBE in accordance with Clause 8.
11. No-Shows or Terminations
11.1 If you do not show up for your booking or terminate your booking early after you have checked in you will be charged a 100% cancellation fee and will be required to pay to CANBE the full amount of your booking less any amount which you have already paid.
12. Check-in
12.1 Standard check-in time is 3:00pm but times may vary for particular Participating Properties and you should confirm the check-in time with the relevant Participating Property prior to your scheduled check-in day.
12.2 If you wish to guarantee your ability to check-in prior to 3:00pm you must book an additional night stay and pay the applicable rate for that additional night.
12.3 Property management may approve a request for an early check-in at their absolute discretion.
13. Check-out
13.1 Standard check-out time is 11:00am but times may vary for particular Participating Properties and you should confirm the check-out time with the relevant Participating Property prior to your scheduled check-out day.
13.2 If you wish to check-out later than the standard check-out time you must obtain approval from property management at least 12 hours prior to your scheduled check-out time.
13.3 Property management may approve a request for late check-out at their absolute discretion.
13.4 If you check-out after 11:00am (without prior approval) the following additional charges will be applied to your account and will be payable by you on check-out:
13.4.1 a surcharge of €20.00 per hour for every hour after 11.00am that you fail to check-out; or
13.4.2 if you check-out after 2pm a charge equivalent to the full daily rate which applies to your booking.
14. Security Deposits
14.1 You must provide a credit card authorisation or imprint when you check-in.
14.2 This authorisation may be used to cover incidental items including but not limited to telephone charges, security bond or deposit for any breakages or damage incurred during your stay or cleaning charges in excess of the normal level of cleaning.
14.3 The pre-authorisation process validates your credit card, and protects both the cardholder and merchant from increasing fraud incidents.
14.4 The pre-authorised amount is set aside by the card issuer for a period of up to 14 days from the date of pre-authorisation and the pre-authorisation will affect your available funds balance or spending limit. For more information on this practice please contact your card issuer.
14.5 Once a pre-authorisation has been made, CANBE cannot release, remove or lower the authorised amount, until we process the final account on departure. This is a restriction imposed by the card issuer, and cannot be negotiated.
14.6 Where a credit card is not available a minimum €200.00 cash deposit will be required on check-in. The actual amount required may be higher at some Participating Properties and you should confirm the amount in advance with Canbe management at the Participating
15. Accommodation Type
15.1 Accommodation at ‘Canbe – Broc House’, ‘Canbe – Five Lamps’ and ‘Canbe – Pearse Street’ is on a holiday apartment/suite basis. You must book an entire apartment/suite for the duration of your stay.
15.2 Accommodation at ‘Canbe – Garden Lane’ is on a holiday hostel basis. The majority of rooms contain two/three single beds and accommodation is allocated on a per bed basis (i.e. you may be required to share a room with others). Some single/double occupancy rooms are available for an extra charge.
15.3 Accommodation at The Maltings B&B is on a B&B basis. Single, double and family rooms are available. You must book an entire room for the duration of your stay.
16. Room Allocation
16.1 CANBE management will allocate you an available room/bed of the type booked at the Participating Property for which you booked at the time of check-in. Room allocation will depend on availability and cannot be confirmed in advance.
16.2 CANBE reserves the right to move you from one apartment/suite/room to another at the Participating Property for which you booked during your stay if necessary.
16.3 In the unlikely event that CANBE cannot provide accommodation at the Participating Property for which you have booked, CANBE will at no additional expense to you relocate you into an alternative property which in the reasonable opinion of CANBE is of comparable quality and in a comparable location.
16.4 If a property of comparable quality in a comparable location is not available, CANBE may relocate you to a property of less comparable quality or less comparable location in which case CANBE will pay you an amount which it reasonably believes represents the difference between the rate payable for the alternate property and the rate paid by you for the Participating Property at which you had booked.
16.5 Should you wish to be relocated to an alternative property other than the property chosen by CANBE under this term, you will be required to pay any difference in price between the CANBE’s choice of property and your chosen property.
16.6 If you and CANBE cannot agree on an alternative property under this clause then you may request CANBE cancel your booking and issue you with a refund for the full amount of that booking less any amounts which you owe to CANBE.
17. Accommodation Servicing
17.1 All bookings at The Maltings B&B include a daily cleaning service.
17.2 At all other Participating Properties, bookings for 7 nights or more include a weekly ‘refresh’ room service (unless otherwise specified at the time of booking). The ‘refresh’ service includes change of bed linen and towels only.
17.3 Additional room services (daily/weekly cleaning) can be arranged directly with the Participating Property and charges will apply. You can enquire about these room services directly with the Participating Property.
18. Children
18.1 All guests under the age of 16 must be accompanied by a responsible adult such as a parent, step-parent, guardian or other adult who has parental rights and responsibilities for the under 16 year old guest.
18.2 If a guest is found to be a person under the age of 16 who is not accompanied by a responsible adult CANBE may immediately cancel the guest’s booking and the full booking amount will be forfeited to CANBE under this clause.
18.3 In most cases, children’s prices for accommodation refer to children occupying the same room/unit with at least two adults and using existing bedding.
18.4 Additional charges may apply if extra beds or linen (including rollaway/sofa beds or cots) are required.
19. Facilities and Services
19.1 Accommodation at The Maltings B&B is on a bed and breakfast basis.
19.2 All other Participating Properties are on a self-catering basis. Holiday apartments/suites have private kitchen/dining facilities. Holiday hostel has communal kitchen/dining facilities.
19.3 Whilst care is taken to ensure that the description of facilities and services offered at CANBE properties are accurate, these are continually being changed, upgraded, and on occasion taken out of service and if any feature/facility is essential to you in choosing a particular property, it is your responsibility to confirm with the property prior to making your booking that the feature/facility will be available during your stay.
19.4 To the extent permitted by law CANBE is not liable for omissions, errors or changes to the facilities and services at a property, whether temporary or permanent.
19.5 Accommodation facilities listed may not apply to all room types.
20. Student Package (‘Canbe – Garden Lane’ only)
20.1 A ‘special offer’ package is offered to 3rd level students. Full details of the package are available by calling +353 1 2196359 or emailing info@canbe.ie.
20.2 This deal is only open to current 3rd level students studying in Dublin with a valid student card which must be shown on check in. An acceptance letter in conjunction with photo ID is also acceptable.
20.3 Bookings can be taken for up to a month in advance. Payment is to be up-front to reserve your bed.
20.4 Students should contact hostel management directly one week prior to the end of the month if he/she wishes to extend their stay. CANBE cannot guarantee the student will be allocated a room as this will be based on availability. If a room is available CANBE cannot guarantee the same bed/room if he/she wishes to stay for more than one month.
20.5 The hostel managers or supervisors have the right to refuse admission to the hostel.
20.6 This offer may not to be used in conjunction with any other discounts or offers.
20.7 This offer is subject to change and availability – we can’t put you in beds if they’re all taken!
21. Use of Alcohol, Smoking and Drugs
21.1 ‘Canbe – Garden Lane’: The responsible consumption of alcohol is permitted in the self-catering dining rooms together with a meal at the discretion of the hostel manager. No alcohol is permitted in the bedrooms.
21.2 All other Participating Properties: The responsible consumption of alcohol is permitted in self-catering apartments/suites.
21.3 Guests are requested to consider the collective needs and comfort of others in the hostel (see Code of Conduct, clause 23 below).
21.4 It is an offence for any person under 18 to buy or attempt to buy alcohol or consume alcohol. Any guests under 18 years found to be consuming alcohol in or around any Participating Property will be asked to leave the Participating Property without refund.
21.5 It is also an offence to buy alcohol for consumption by a person under 18. Any guest found to have purchased alcohol for any other guest or person visiting any Participating Property aged under 18 years will be asked to leave the Participating Property without refund.
21.6 All Participating Properties are non-smoking buildings and under Irish law it is an offence to smoke anywhere within any Participating Property. Smoking is permitted only in designated areas outside the Participating Properties.
21.7 The use of illegal drugs is strictly prohibited in and around any Participating Property at any time. If the CANBE management/staff suspects that a person is in possession of illegal drugs, he or she will contact the local police.
22. Code of Conduct
22.1 Guests are required to give due consideration to the collective needs of other guests in the Participating Properties, to take due care of the facilities provided and to respect the shared environment. In the interest of maintaining community relations, we expect all guests to refrain from any activity likely to antagonise the local community or bring the Participating Property into disrepute.
22.2 Visitors are allowed between the hours of 8am and 10pm only. No overnight visitors are permitted without prior approval of management. No more than 4 visitors allowed at any time.
22.3 Loud music / noise are not permitted in rooms/apartments before 8am and after 10pm.
22.4 No access to the roof gardens (‘Canbe – Broc House’, Canbe – Pearse Street and ‘Canbe – Garden Lane’ only) is permitted after 10pm (May-Sept) and after 8pm (Oct-Apr).
22.5 CANBE does not permit any pets in any of our Participating Properties.
22.6 The use of candles, camping stoves, barbecues, fireworks or other hazardous item within or in the vicinity of any Participating Property is strictly prohibited at all times.
22.7 Any guest displaying unacceptable behaviour will be asked to leave the Participating Property without refund.
22.8 All Participating Properties have either a residential or on-call manager/staff member who are contactable during your stay.
22.9 CANBE management and staff reserve the right to call for assistance from any of the emergency services at any time.
23. Special Requests
23.1 Whilst CANBE attempts to satisfy all special requests, CANBE does not guarantee that special requests can be accommodated.
24. Wheelchair Access
24.1 Not all Participating Properties are wheelchair accessible. You should enquire directly with the Participating Property in advance of booking if you require wheelchair access.
25. Parking
25.1 Not all Participating Properties have parking facilities. You should enquire directly with the Participating Property in advance of booking if you require parking facilities.
26. Maps and Images
26.1 Map images, if shown, are for general information and may not necessarily reflect actual routings, locations or services provided.
26.2 Destination shots may have been supplied to CANBE by third parties and CANBE does not guarantee the accuracy of any destination shots.
26.3 Photos and floor plans are indicative only. Actual rooms occupied may vary in decor and inclusions from those shown.
27. Insurance
27.1 All Participating Properties are covered CANBE’s standard protection and liability insurances. If you require a copy in advance, this can be obtained on request directly from the property. Customers are not, however, covered by our insurance for personal injury, damage or theft of property whilst in a Participating Property, or public transport delays/cancellations. You are advised to ensure that you are covered independently for such events.
27.2 CANBE strongly recommends that at the time of booking you purchase comprehensive travel insurance to cover items including but not limited to: loss of booking amount through cancellation, loss or damage to personal baggage, loss of money and medical expenses.
28. Complaints
28.1 In the unlikely event that you encounter problems during your stay please inform us as soon as they happen. If you have a justifiable complaint you should notify the Participating Property Manager immediately. If any complaint is not resolved immediately or cannot be dealt with at the time, you should write to The Manager, CANBE Limited, Castle Street, Birr, Co. Offaly within 28 days of your stay or email us at info@canbe.ie.
29. Release, indemnity and proportionate liability
29.1 To the extent permitted by the law, you agree to release, indemnify and hold harmless, CANBE and its current and former officers, employees, contractors, sub-contractors/consultants (including their respective employees and contractors) and agents against, from and in respect of all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including but not limited to consequential and economic losses, property loss/damage and damages for injury, including personal injury and death) arising out of, caused by, attributable to or resulting from your booking or your stay at the relevant Participating Property except to the extent such expense, cost, liability, claim, action, proceeding, damage, judgment or loss arose out of, was caused by, attributable to or resulted from CANBE’s negligence, wrongful act/omission or breach of these terms and conditions.
29.2 To the extent permitted by law the aggregate of CANBE’s liability to you is limited to an amount not exceeding the amount paid by you for your booking.
29.3 Each indemnity in these terms and conditions is a continuing and independent obligation and survives the termination or expiry of these terms and conditions.
30. Consumer Law
30.1 To the extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied or conferred by statute, custom or the general law that impose any liability or obligation on CANBE are excluded under these Terms and Conditions.
30.2 Nothing contained in these Terms and Conditions excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under Consumer Law or under any international consumer protection legislation, provided that, to the extent that such law permits CANBE to limit its liability, then CANBE’s liability is limited to:
30.2.1 in the case of services, supplying the services again or payment of the cost of having the services supplied again; and
30.2.2 in the case of goods, replacing the goods, supplying equivalent goods or repairing the goods, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired.
31. Events Beyond Control
31.1 CANBE is not responsible for any loss arising out of any occurrences or conditions beyond its control, including but not limited to acts of terrorism, act of God, defects in vehicles, war, strikes, theft, delay, cancellation, civil disorder, disaster, Government regulations or changes in itinerary or schedule.
31.2 All travel documents, observance of laws and government regulations are your responsibility.
32. Use of Information
32.1 You consent and authorise CANBE and the relevant Participating Property to collect, use and disclose your personal information for the purposes of administering your booking and providing you with any services associated with your booking.
32.2 You consent to information which you have provided to CANBE or the relevant Participating Property as part of your booking being used by CANBE, the relevant Participating Property or any of their related bodies corporate for the purpose of informing you about offers and promotions which relate CANBE, CANBE’s related bodies corporate or Participating Properties.
32.3 CANBE will not provide or disclose any information you have provided to CANBE or the relevant Participating Property to any person other than a related body corporate without your prior written consent.
32.4 Upon request by you and to the extent permitted or required by law, CANBE will provide you with access to and/or the ability to correct your personal information; however only the person who made the booking will be entitled to access and/or correct personal information pertaining to that booking.
33. General
33.1 The Terms and Conditions are governed by and will be construed in accordance with the laws of Ireland.
33.2 If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable then it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
